Charter Agreement — Playcraft Charters, Malta

This Charter Agreement is made between the RHIB Owner (Playcraft Charters) and the Charterer for the charter of the agreed vessel. The port of boarding and return is Msida Creek Marina, Msida. Cruising areas are limited to Maltese territorial waters only, including Gozo and Comino.

Price & Payment

1.

The charter price is agreed upon at the time of booking.

2.

A booking deposit is to be paid upon provisional booking to secure the charter dates.

3.

A security deposit is to be paid on the charter day upon delivery of the RHIB. This covers fuel charges on return and any damages. The charterer is fully reimbursed for the remaining amount after refueling, provided the RHIB is returned in good condition.

4.

In the event of damages, the cost shall be deducted from the security deposit. If damages exceed the deposit, the charterer shall pay the difference. In the case of excessive damage or total loss, an insurance claim will be issued by both parties.

5.

Exceeding the charter duration incurs an extra charge of €50 per hour. If overtime exceeds 2 hours, a fee of €150 per hour applies.

6.

The charterer is entitled to a full deposit refund if the booking is cancelled at least 72 hours before the charter start. Cancellations within 72 hours may result in the deposit being withheld.

7.

In the event of a delayed collection, the RHIB will remain available until the agreed end time without price amendments. If the charterer does not show up without prior notice, full payment shall apply.

8.

The charterer is not entitled to a refund for early return of the RHIB.

9.

In the event of bad weather preventing the charter, the deposit is withheld and a new reservation will be made.

10.

The RHIB is provided with a full fuel tank. If fuel runs out and assistance is required, an additional charge applies.

11.

All charters are subject to weather-permitting conditions. If cancelled by the owner due to weather, the deposit is withheld and a new date is agreed, or the deposit is refunded at the owner's discretion.

Charterer Responsibilities

A.

Provide proof of Nautical licence on charter day.

B.

Is fully responsible for the correct use of the RHIB and cannot entrust it to others under any circumstances.

C.

Must carefully read all rules in this contract prior to departure.

D.

Shall use the RHIB only within Maltese national waters, including Gozo and Comino.

E.

Cannot carry more passengers than the agreed maximum capacity.

F.

Assumes responsibility to comply with national provisions of current navigation, safety, and health protection rules.

G.

Is solely responsible for any damage or injury suffered by people on or off board during the charter.

Key Rules

NO PETS are allowed on the RHIB at any point during the charter.

The RHIB shall not be sublet without prior notification to the owner.

Excessive amounts of alcohol are PROHIBITED on board.

ALL ILLICIT/ILLEGAL SUBSTANCES, including but not limited to drugs, are PROHIBITED on board at all times.

The RHIB shall be used exclusively as a pleasure vessel. It shall not be used to transport merchandise, carry passengers for pay, or engage in trade or sports activities (e.g. water skiing).

The charterer must return the RHIB to the Port of Return in perfect condition, complete with all safety equipment provided at the start of the charter.

All documentation regarding the nautical licence must be provided on the day of the charter or the owner reserves the right to refuse the lease.
